BACKGROUND

SB 1918 was recently passed by the California Senate to redefine "pedestrians" to include users of a "electric personal assistive mobility device" (Segway scooters, www.segway.com ) that can go up to 20 mph. Devices travelling at such speed on sidewalks are a clear danger to pedestrians. The law is written to only cover devices patented by the Segway Company. Due to intense lobbying efforts by Segway, we expect the law to pass the California Assembly and be passed into law in the next few months. SOLUTION

We ask that you sponsor legislation that would ban Segway scooters and other motorized devices from sidewalks, except for operators unable to move about as a pedestrian using self-propelled wheelchairs, invalid tricycles, or motorized quadricycles as specified in California Vehicle Code 467 (b). We ask that this ban take place immediately and last until studies show that the Segway devices are inherently safe and compatible with pedestrians on sidewalks in a San Francisco-style dense urban setting. The ban should be specifically for sidewalks and not for multi-use paths that are designed for simultaneous use by pedestrians and vehicles (such as the multi-use paths in the panhandle and in Golden Gate Park).

The proposed California legislation specifically states that local jurisdictions can regulate the use of Segways:

21282. For the purpose of assuring the safety of pedestrians and others using sidewalks and bike paths, a city, county, or city and county may, by ordinance, regulate the time, place, and manner of the operation of electric personal assistive mobility devices.

SUPPORTERS

The main supporters of this proposed legislation include Walk San Francisco, Senior Action Network, and disability organizations. We expect that getting additional support of neighborhood and transportation groups should be very easy. We also expect support from city agencies, including Department of Public Health and the Department of Parking and Traffic, and broad support from other Supervisors. Due to the clear danger to pedestrians, and because there is no current constituency for the devices (they are new), we do not expect significant opposition, except from the lobbyists of the Segway company.

ARGUMENTS IN FAVOR OF BANNING SEGWAYS FROM SIDEWALKS

Segways and Motorized Scooters are dangerous to pedestrians.

Riding on the sidewalk is dangerous for Segway operators.

Allowing Segways and motorized scooters on sidewalks has not been proven to be safe.

The use of Segways and motorized scooters is detrimental to public health.

The Segway legislation is undemocratic.

Segways shift pollution.

Segways will not reduce car trips as purported.
